The design-builder is usually the general contractor, but in many cases it is also the design professional architect or engineer. Design and build is a term describing a procurement route in which a single contractor is appointed to design or complete the design and then to construct the works. The JCT ranges in publications from standard contracts, to major construction projects or a Design and Build Contract which is designed for construction projects where the contractor carries out both the design and the construction work. The simple concept that makes Design and Build Contracts different to traditional is that the Employer seeks to transfer more design responsibility to the Contractor. The Contractor has greater design input on a Design and Build Contract than with the traditional procurement route. Design and Build is a modern Procurement Route in construction , unlike in other industries where it has been in use for a long period of time. Construction has lagged behind due to the emergence of architecture as a profession that has led the industry for the majority of the past century. There have been numerous changes to the wording of the contracts and in this first bulletin in a series of two we will be looking at the key changes that have been made to the Design and Build Contract. JCT believe that including the same IVD at main contract, sub-contract and sub-subcontract level will promote fairer payment down the supply chain, but it appears there will be limited benefit to sub-contractors unless main contractors decide to adhere to the JCT payment periods rather than substantially extending them, as is currently common. The IVD acts as both the trigger for the due date for payment and the point in time at which the Gross Valuation is calculated. JCT have made an effort to simplify the clauses relating to payment. Notably, the provisions relating to the Final Statement have now been moved to clause 4. In addition, the previously rather complicated clause 1.

The DB provides that the first Interim Valuation Date must be specified in the entry in the Contract Particulars against clause 4. As stated in the footnote corresponding with that entry the JCT recommends the first Interim Valuation Date should be not more than one month after the Date of Possession. Subsequent Interim Valuation Dates are to be the same date in each month. The Contractor is required to make an Interim Payment Application in respect of each Interim Payment in the manner specified in clause 4. If the application is received no later than the relevant Interim Valuation Date the due date is that date seven days after the relevant Interim Valuation Date.
